SWEARS OF SPANISH NATIONALITY

On April 2, 2013, an agreement was signed between the Ministry of Justice and the General Council of Notaries by which Notaries will record in a notarial document the oath or promise of persons whose nationality files by residence have been processed by the Government since December 2012.

The oath or promise is the last existing requirement to enjoy Spanish nationality, the obligation of which derives from article 224 of the Civil Registry regulations, which establishes that within one hundred and eighty days following the notification of nationality, the applicant must appear before the competent official to, where appropriate, renounce the previous nationality, take the required promise or oath and register as a Spaniard in the Registry.

The official responsible for collecting the oath of nationality is the person in charge of the Civil Registry, however, by virtue of the agreement signed to which we have referred above, notaries must collect free of charge the oaths or promises of obedience to the King, the Constitution and the Laws of these persons, as well as, where appropriate, the renunciation of their previous nationality, the establishment of their civil residence and the determination of the name and surnames adapted to Castilian. However, the Oath in a Notary's Office is optional, since it can also be done in the Civil Registry corresponding.

The Ministry of Justice has undertaken to make the data and documents of the nationality applications available to the General Council of Notaries in electronic format, for which it will use a web services system for exchanging information.

For its part, the General Council of Notaries, through the Notarial Associations, will provide notaries with technical support so that they can carry out the acts necessary to fulfill this task.

In view of the large number of requests for information that we are receiving about whether the system is already available, my Notary would like to state that as of today, the system is not yet operational. In any case, we will announce through this channel, as soon as it is possible, the time and manner in which the nationality oaths can be carried out from my office.

The last phase of the process of acquiring Spanish nationality, which is the oath or promise, has been formalized in notary offices until December 31, but the acquisition of Spanish nationality by residence is a process that is processed before the civil registry.
